Provisions in Regulation 70 under the CFSA that prescribe forms for agreements for the temporary care and custody of a child are proposed to be remade in regulation under the CYFSA. Minor changes are proposed to these regulatory provisions to replace references to the CFSA with references to the corresponding provisions in the CYFSA.

Provisions in Regulation 70 under the CFSA that reference "special needs agreements" will be revoked when the CFSA is repealed since the authority to enter into special needs agreements is not included in the CYFSA.

Continuing care supports:

The ministry is anticipating that changes will be made to O. Reg 206/00 under the CFSA in order to support changes to the CFSA to extend child protection services to 16- and 17- year old youth, which will be proclaimed into force on January 1, 2018. The majority of provisions concerning continuing care supports in O. Reg 206/00 under the CFSA (as it will read on January 1, 2018) are then proposed to be remade in a regulation under the CYFSA with very few substantive changes (e.g. replacing references to the CFSA with references to the corresponding provisions in the CYFSA).

In addition, the regulation under the CYFSA is proposed to include language to clarify the circumstances when youth would not be eligible for continuing care supports where it would be duplicative of other financial supports being provided to the youth (e.g. Stay Home for School supports).
